DECI LONDON’s (“DECI LONDON” “we”, our, “us”) website(s) (our “Site” or “Sites”) and related services are made available to you in accordance with the following Terms of Use & Service, and any other rules posted on our Sites (collectively, the “TOU”). Please read the TOU carefully before placing any orders on www.decilondon.com. We recommend you should keep a copy of the TOU for future reference.

ELIGIBILITY TO PURCHASE
In order to make purchases on the Site you will be required to provide your personal details. In particular, you must provide your real name, phone number, e-mail address and other requested information as indicated. Furthermore, you will be required to provide payment details that you represent and warrant are both valid and correct and you confirm that you are the person referred to in the Billing information provided.
The Site is available only to individuals and others who meet the DECI LONDON terms of eligibility, who are over the age of 18 and entitled to enter into legally binding contracts and as a result are the only people entitled to transact through this site; who have been issued a valid credit/debit card by a bank acceptable to DECI LONDON, whose applications are acceptable to DECI LONDON and who have authorized DECI LONDON to process a charge(s) on their credit/debit card in the amount of the total purchase price for the merchandise which they purchase. DECI LONDON reserves the right to restrict multiple quantities of an item being shipped to any one customer or postal address.
By making an offer to purchase merchandise you expressly authorize us to perform credit checks and where DECI LONDON feels necessary, to transmit or to obtain information (including any updated information) about you to or from third parties, including but not limited to your credit/debit card number or credit reports (including credit reports for your spouse if you reside in a community property jurisdiction), to authenticate your identity, to validate your credit/debit card, to obtain an initial credit/debit card authorization and to authorize individual purchase transactions.
Furthermore, you agree that we may use Personal Information provided by you in order to conduct appropriate anti fraud checks. Personal Information that you provide may be disclosed to a credit reference or fraud prevention agency, which may keep a record of that information.

ORDERS
All orders are subject to acceptance and availability, and items in your shopping basket are not reserved and may be purchased by other customers.
We must receive payment in whole for the price of the goods that you order before your order can be accepted. Once payment has been received by us we will confirm that your order has been received by sending an email to you at the email address you provide in your order form. This is not an Order Acceptance from DECI LONDON. Our acceptance of your order takes place on the dispatch to you of the products ordered unless we notify you that we do not accept your order, or you have cancelled your order in accordance with our cancellation policy. Our acceptance of your order brings into existence a legally binding contract between us. Any individuals who are unable to perform legally binding contracts are prohibited from ordering goods using this site. If you do not qualify do not use this site.
PRICING POLICY, DELIVERY AND PROMOTIONAL CODES
The prices payable for goods that you order are as set out in our website. All of our prices are quoted in GBP and are UK VAT inclusive. You will be billed in UK Pounds and if you purchase from outside the UK, currency fluctuations and credit card charges may make a difference to the amount billed on your credit card, as the final price will be calculated in accordance with the applicable exchange rate on the day your card issuer processes the transaction. Please note that any duty and taxes incurred in the country of destination are the responsibility of the customer.
Estimated delivery times are to be used as a guide only and commence from the date of dispatch. DECI LONDON is not responsible for any delays caused by destination customs clearance processes.
Promotional discount codes: We may from time to time offer promotional discount codes (either directly or via third parties) which may apply in respect of any, or certain specified, purchases made though this Website. Such codes may only be applied to purchases of full-price items and cannot be used in conjunction with any other offer or discounts; they must be redeemed by the date published, if provided; are non-transferable and there is no cash alternative.

INSURANCE
DECI LONDON insures each purchase during the time it is in transit until it is delivered to your specified delivery address. We require a signature for any goods delivered, at which point responsibility for your purchased goods passes to you. If you have specified a recipient who is not you for delivery purposes (for example as a gift) then you accept that evidence of a signature by them (or at that delivery address) is evidence of delivery and fulfillment by DECI LONDON, and transfer of responsibility in the same way.
ACCEPTANCE OF YOUR ORDER
Once you have made your choice and your order has been placed, you will receive an email acknowledging the details of your order. This email is NOT an acceptance of your order, just a confirmation that we have received it.
Unless you cancel your order, acceptance of your order and completion of the contract between you and DECI LONDON will be completed when we email you to confirm the goods have been dispatched. The sale contract is therefore concluded in London, England and the language of the contract is English.
We reserve the right not to accept your order in the event, for example, that we are unable to obtain authorization for payment, that shipping restrictions apply to a particular item, that the item ordered is out of stock or does not satisfy our quality control standards and is withdrawn, or that you do not meet the eligibility criteria set out within the TOU.
We may also refuse to process and therefore accept a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any merchandise from the Site whether or not that merchandise has been sold, removing, screening or editing any materials or content on the Site, refusing to process a transaction or unwinding or suspending any transaction after processing has begun.
PAYMENT
Payment can be made by Visa, Visa Electron, Visa Debit, Visa Delta, MasterCard, Maestro debit cards, and any other methods which may be clearly advertised on the Site from time to time. Payment will be debited and cleared from your account upon dispatch of your order by DECI LONDON. You confirm that the credit/debit card that is being used is yours or that you have been specifically authorised by the owner of the credit/debit card to use it. All credit/debit card holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to DECI LONDON, we will not be liable for any delay or non-delivery.
We take reasonable care to make our Site secure. All credit/debit card transactions on this site are processed using SAGEPAY, a secure online payment gateway that encrypts your card details in a secure host environment.
To help ensure that your shopping experience is safe, simple, and secure, DECI LONDON uses Secure Socket Layer (SSL) technology.
Furthermore, we take reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering from the Site.
DELIVERY OF GOODS
We will deliver the goods ordered by you to the address you give us for delivery at the time you make your order. It is your responsibility to ensure that the delivery address you give us is correct and accurate and that there is somebody to sign for and take delivery of the goods from the delivery service used. Goods ordered by you are usually shipped within 24hr of acceptance of payment and order confirmation.
You will become the owner of the goods you have ordered when they have been dispatched to you. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.
If your order is returned to us because the courier or postal service could not complete the delivery to you for whatever reason, then you will be responsible for the repeat delivery costs.

CANCELLATION OF ORDER
You do not need to give us any reason for canceling your contract nor will you have to pay any penalty. Your right to cancel your contract with us for the goods you have ordered is subject to:?a) You not having worn or damaged the jewellery.?b) You returning the jewellery in its original packaging with all tags intact.?c) The item(s) cannot be a Bespoke Special Order, which due to their unique nature, cannot be exchanged or returned under any circumstances.
If you are based in the EU under the Consumer Protection (Distance Selling) Regulations 2000 (DSRs), you have the right to cancel your order with us, provided you give us written notice within 7 working days of receipt. Notice of contract cancellation under the DSRs must be given in writing to: Contract Cancellation Notice, Customer Care Department, Deci London, 258 Chiswick Village, London W4 3DF, UK or by email to: customercare@decilondon.com
For orders cancelled under the DSRs, we will issue you with a full refund including the shipping cost. However, you will need to return the entire order to us by secure means to ensure it reaches us in good condition, at your own cost. Cancelled orders should be returned to: Customer Care Department, Deci London, 258 Chiswick Village, London W4 3DF, UK All items must be returned unused and in their original condition, from the original delivery country.
We recommend that you insure the return shipment as you are under a duty to take reasonable care of the goods and will be liable for damage to them until we receive them at our premises. In case of dispute, we also recommend you retain proof of sending. Refunds will be issued within 30 days of us receiving your cancellation notice and PROVIDED THAT the goods in question are returned by you and received by us in the condition they were in when delivered to you. If you do not return the goods delivered to you, in the way detailed above, we shall be entitled to deduct the direct costs of recovering the goods from the amount to be credited to you.
Please note you may only use your right to cancel the order under the DSRs if you give us formal written notice of cancellation within 7 working days of receiving the order, by email or post as described above.
RETURNS & EXCHANGES
- We request that all goods being returned from within the UK are returned within 7 days
- Returns received outside the above time frames are accepted at the discretion of DECI LONDON
- DECI LONDON will not accept returns for any items that have been worn or have had their tags removed. Upon receipt of an order, if any item has been received with no tags, you should notify us (by phone or email) on the same day if you wish to return the item
- ? We strongly advise all customers to check their purchase thoroughly upon delivery before removing any attached tags and before disposing of any original packaging
- In the event of failure to return any item to us within the time limits stated, even though validly cancelled, we reserve the right to charge any costs of recovery of the goods
- Please be aware that international customs duties and sales taxes are NOT refunded for shipments outside the European Community (EU)
- Bespoke items – items that we do not currently carry in stock – and Special Orders cannot be exchanged or returned under any circumstance
- In the event that you may require exchanging the ordered item(s) for another, you must contact or write to us on customercare@decilondon.com within seven days of receiving your order and discuss the request for an exchange.
- Exchanges for the same item but in different size are subject to stock availability. If you wish to exchange your item for an alternative product, we suggest that you return it for a store credit and purchase the new item separately.
HOW TO RETURN GOODS
1. In order to facilitate the return of your items, you must obtain a Return Form by emailing us at customercare@decilondon.com within 7 days of receiving your order.?2. All returns for any particular order must be returned in one shipment. Any subsequent returns from the same order may incur additional shipping charges to you?3. All items must arrive with the security tag intact, be unworn and in their original condition?4. Please complete the Returns Form and enclose it with the item(s) to be returned?5. Please place items in the original packaging and ensure the outer box is completely sealed?6. We request that returns from the UK are shipped through Royal Mail Special Delivery. Please note that we do not accept liability for returned goods if you do not return them to us via Royal Mail Special Delivery.
If you are sending returns from overseas, You will be responsible for arranging to have the item(s) returned to us, and for any costs incurred. We are not responsible for any items which do not reach us. Please ensure that you write clearly on the shippers paperwork that the item is being returned, and send to: Deci London, 258 Chiswick Village, London W4 3DF, UK.
RECEIVING A REFUND
Refunds will be made within 30 days of the date of cancellation notice, subject to DECI LONDON having received the goods back in acceptable condition, as outlined in the TOU policy. The cost of any undamaged and unworn products, correctly returned will be credited to the original purchaser’s credit card, including sales taxes for all EU country shipments but excluding shipping charges. As previously stated, international customs duties and sales taxes are non-refundable for shipments outside the European Community (EU). ? ?GIFT RETURNS?If you have received an item from Deci London as a gift you can return it for exchange within the parameters outlined in this Returns Policy. FAULTY GOODS
Goods are faulty if they are received damaged or where a manufacturing fault occurs within six months of purchase. Items that are damaged as a result of normal wear and tear are not considered to be faulty.
If you would like to exchange a faulty item instead of obtaining a refund, please be aware that we can only replace it for the same product in the same size, subject to availability. Where possible, we will offer to repair faulty items. If it cannot be repaired or the same product is not available, you are entitled to a full refund.
CONTENT AND INTELECTUAL PROPERTY RIGHTS
“Content” is defined as any graphics, photographs, including all image rights, sounds, music, video, audio or text on this Site. DECI LONDON tries to ensure that the information on this site is accurate and complete, however we do not promise that Content is accurate or error-free. DECI LONDON does not promise that the functional aspects of the Site or DECI LONDONs Content will be error free or that this Site, DECI LONDON Content or the server that makes it available are free of viruses or other harmful components. We always recommend that all users of the Internet ensure they have up to date virus checking software installed.
Your use of the Site and its contents grants no rights to you in relation to any copyright, designs, trademarks and all other intellectual property and material rights relating to the Content. All materials including images, illustrations, designs, layout, photographs, written and other text or script that are part of this Site are protected by copyright, trade mark, trade dress and/or other intellectual property rights owned, controlled or licensed to DECI LONDON. You may download or copy the contents and other downloadable materials displayed on the site for copy for the purposes of viewing Content for your own personal use or for the sole purpose of placing an order with DECI LODON or using the site as a shopping resource. No right, title or interest in any downloaded materials or software is transferred to you as a result of any such downloading or copying You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, commercially exploit, create derivative works from, transfer, or sell any Content, software, products, or services contained within this Site. YOUR RIGHTS
You have certain rights under the law. In England these include: That any products you order through this Site will be of satisfactory quality, fit for their intended purpose, and will conform to any description given on this Site; certain remedies if a product is defective; and a right to cancel any order for a product within seven working days commencing on the day after the date on which you receive it, and receive a full refund even if it is not defective.

GOVERNING LAW
The TOU together with all our policies and procedures will be governed by and construed in accordance to the relevant United Kingdom law and the relevant courts of the United Kingdom will have exclusive jurisdiction.
OUR RIGHTS
We reserve the right to change the Conditions from time to time, and your continued use of the Website (or any part thereof) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Conditions have been changed. If you do not agree to any change to the Conditions then you must immediately stop using the Website.

ENTIRE AGREEMENT
These Terms of Use, together with our current website prices, delivery details, contact details and privacy policy, set out the whole of our agreement relating to the supply of the goods to you by us. Nothing said by any sales person on our behalf should be understood as a variation of these Terms of Use or as an authorised representation about the nature or quality of any goods offered for sale by us. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.
We make no representations or warranties about the accuracy completeness or suitability for any purpose of the information and related graphics published on our website. From time to time our site may contain technical inaccuracies or typographical errors.
EVENTS BEYOND OUR CONTROL
We will not be in breach of this Agreement or otherwise liable for any delay in performance if to the extent that any delay or failure is due to circumstances beyond its reasonable control including, without limitation, strikes, lockouts and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.
